
Terms & Conditions of Service (Last Update: 7/13/2024)
1. User's Acknowledgment and Acceptance of Terms
Correspond LLC (“Us” or “We”) provides the Correspond.info site and various related services (collectively, the “site”) to you, the user, subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms of Use”), as well as any other written agreement between us and you. By accessing, downloading, and/or using the Site and/or the Services, you signify your acceptance of all provisions of the Correspond Terms of Use as set forth herein and all features and functionalities, website, and user interfaces, as well as all content and software associated with our service. THESE USER TERMS CREATE A BINDING LEGAL AGREEMENT BETWEEN YOU AND CORRESPOND. If you do not agree to the Terms of Use, please exit the Correspond Site and if purchased, do not continue your Membership by cancelling. Correspond expressly reserves the right to make changes to our terms at any time without notice to you. Your continued use of our site and your Membership following any changes to these terms will mean that you accept such changes. If you have questions or concerns regarding the Terms of Use, please contact Correspond as directed below.
2. Correspond Membership
Correspond offers a membership based service plan. This Agreement is for the individual member (“Member” or “You”). This Agreement commences on the date of registration and if a membership is purchased continues until the Agreement is cancelled or terminated in accordance with the terms and conditions set forth herein. You are considered a Member after payment of the Initiation Fee, and until the official end date of your program abroad.
3. Description of Services Offered

General Membership Program. Through the Correspond website and/or by email communication, a customer will choose a specified plan based on customer needs and wishes. By signing the plan, the customer agrees to Correspond's Terms & Conditions of Sevice and it will be used as a contract between the customer and Correspond. A customer becomes a Member after signing the plan, and after paying the Initiation Fee.

In addition to the General Membership Program, membership entitles the Member to ask Correspond an unlimited amount of questions and may seek contact at any time.

As a Member you have the option to have us arrange your placement at a company and the visa process that follows, or only use our services to arrange your visa if you have already found a host company at your own discretion.
4. Member Eligibility
If you Request for a Membership, you represent and warrant that you (a) are not under the age of 18; (b) are not registering under a false name or with false information; (c) you are authorized to use the form of payment submitted for membership; (d) will not use other Members’ accounts and will not let others use your account; (e) will not attempt to or actually override any security component included in the Member Web Site or Mobile Application; and (f) will comply with the Member Terms of Use at all times.

Your Request for a Membership will only be considered after we have reviewed (a) your visa eligibility; (b) your resume; (c) your host company (if self-placed); and (d) your level of English.
5. Passwords & Account Access
Correspond is actively working on providing a membership account service. The Member who created a Correspond membership account is referred to as the Account Owner. The Account Owner has access and control over his/her account through the use of an identification name and password. The Account Owner has exclusive control over such information. Because your account may contain credit card information, you should not reveal such information to anyone. By sharing such information, the Account Owner agrees to be responsible for the misuse of such information.
6. Payment and Billing

Payments. All payments, including upgrades and additional services, are payable by electronic funds transfer from the Member’s credit or debit card account or wire transfer. Members must authorize payments to be made through a third party administered electronic funds transfer system. Credit card information must be received and processed in order for memberships to become effective.

Recurring Billing. If you choose not to pay in full for your invoices, then you have to option to opt-in monthly/weekly payments OR recurring billing. In case of recurring billing, you authorize us to charge you a fee at the then current rate, and any other charges you may incur in connection with your use of the service to your Payment Method. You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to initiation and service fees, promotional offers and/or changing or adding a plan, and/or requesting additional car wash related services and/or goods and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly in one or more charges.

One-time Charges. Correspond will charge an initiation fee as described on the payment section of your membership application. In addition, you may choose to add additional services to your membership plan, including but not limited to: a location preference. An initiation charge and/or additional services charges are one-time charges and will be electronically charged to the credit or debit card provided at the time of initiation or the service is provided.

Price Changes. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. The price change will not apply to you once you become a Correspond member. It will only apply to future applicants.

7. Termination by Correspond.
Correspond may terminate your membership at any time for your failure to comply with its policies and procedures. Correspond reserves the right, at its sole discretion, to refuse to honor any request for Membership. If you violate our Privacy Policy and/or our Terms & Conditions of Service, then we reserve the right to not provide you with any sort of refund.

8. Member Cancellation Policy
You may cancel your Correspond membership at any time by contacting Correspond at info@correspond.info. If you opted in monthly recurring payments, then your membership will be cancelled effective 1 day from your NEXT bill date. You will continue to have access to our services through the end of your next billing period.

9. Changes to Membership Plans

As initiation fees are non-refundable after we started working on your placement or visa, you may choose to postpone our services at any time, as well as moving your start date to a new date in the future.

If you selected a specific location for your program abroad, you cannot select a new second location unless you pay a new location preference fee.

10. Compliance with the Law
You must comply with all applicable governing laws at all times regarding your Membership.

11. Marketing
By signing this Agreement you agree to allow Correspond and its affiliates to market products and services to you in any form including, direct mail, email, telephone, texting or other means available. Correspond agrees not to sell member’s information to any third parties for the purpose of marketing.
12. Privacy Policy
The Correspond Member Privacy Policy applies to you. The Privacy Policy is available for review at www.correspond.info/privacy-policy. Personally identifying information is subject to our Privacy Policy the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices.

13. Copyright Provisions
You agree at all times to honor all applicable copyright law with respect to Member Web Sites, application, emails and e-Newsletters. As such, you may not duplicate, license, sublicense, publish, broadcast, transmit, distribute, perform, display, sell, rebrand, otherwise transfer or commercially exploit Correspond information except as specifically authorized in writing by Correspond. In addition, you may not remove any copyright, trademark or other proprietary rights notices contained anywhere on Correspond material, whether electronic or in writing and may not infringe or use the Correspond brand, logos and/or trademarks without authorization.

14. Indemnification
You agree to indemnify Correspond and hold Correspond harmless from any damages, losses and costs (including, but not limited to, reasonable attorneys’ fees) related to third party claims, charges or investigations, caused by your failure to comply with the Member Terms of Use, including, without limitation, your violation of copyright law that violates third party rights or applicable laws.

15. Limited Liability
To the extent permissible under applicable laws and jurisdictions, in no event shall Correspond, or its subsidiaries or any of their shareholders, directors, officers, employees or licensors be liable (jointly or severally) to you for personal injury, property damages or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever as a result of your use of the services offered by Correspond.

16. Disclaimers
Correspond does not guarantee that the Membership services which it provides will function without interruption or errors in functioning. Correspond may modify, replace, refuse access to, suspend or discontinue the Member Web Site or Member e-Newsletters, partially or entirely. Correspond reserves all rights not expressly granted herein, including, without limitation, title, ownership, intellectual property rights, and all other rights and interest in Correspond's website and Member e-Newsletters and all related items. Correspond neither warrants nor represents that your use of the Member Web Site or e-Newsletters will not infringe the rights of third parties.

17. Waiver
The failure of any party at any time to require performance of any provision or to resort to any remedy provided under this Agreement shall in no way affect the right of that party to require performance or to resort to a remedy at any time thereafter, nor shall the waiver by any party of a breach be deemed to be a waiver of any subsequent breach. A waiver shall not be effective unless it is in writing and signed by the party against whom the waiver is being enforced.

18. Severability
The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.

19. Complete Agreement
This Agreement constitutes and embodies the full and complete understanding of the parties hereto, and supersedes all prior understandings whether oral or written.

20. Governing Law
The law of the United States of America shall govern the validity, interpretation and enforcement of this Agreement. Any action brought with respect to this Agreement shall be brought in appropriate tribunal in California or Texas and the Merchant agrees to waive personal jurisdiction in the event of such a dispute.
